Please find attached 2 separate Notice letters in regards to the files mentioned above. Please note that file F21-85818 is for review of records denied to you pursuant to section 3 of FIPPA and file F21-85819 is a complaint file in regards to the video and audio footage not being available due to technical difficulties.
Please note that our office will not be reviewing issues in regards to your request for incidents files 2016-4473 and 2016-5822. As per Port Moody Police Department’s response those files are either with North Vancouver RCMP and Coquitlam RCMP respectively. Please submit your requests for records to directly to those public bodies if you have not done so yet. If for any reason you are unable to obtain those from RCMP, please submit a request for review to the Federal Information Commissioner. In response to your three letters dated yesterday, April 19th 2021, I ask of you, or of any other person, to understand again that bureaucratic delay has only made my person physically ill while injustice has continued to impale my person. In moving ahead and simplifying the request, the outstanding issues are listed without preference of priority as:

Issue #1.) Audio and video recordings of the Port Moody Police cell blocks from February 19th 2021, to February 22nd 2021, along with the non-corrupted audio recorded during September 6th 2020 and the consecutive related days of incarceration.
Issue #2.) Audio and video recordings of the Bail Hearings on February 20th 2021, and February 22nd 2021, and the non-corrupted audio recording of the Bail Hearing during the September 6th 2020, incarceration.
Issue #3.) Audio recordings and proper transcripts used for Witness Statements in the Port Moody Police Narratives which were submitted to the Crown for Court Files 98702-7B and 104604-1..
Unless I am mistaken, in September of 2020, I had made reference to the police having the ability to simply deny body-cam footage due to “technical difficulties” in my answers provided to a public survey regarding the evolution of public safety in Port Moody (https://dan.berladyn.online/2020/09/01/survey/). It is interesting to see the same given response listed here:
“F21-85819 is a complaint file in regards to the video and audio footage not being available due to technical difficulties.”Visible from the Cell Block is a sign that states words to the effect that both Audio and Video are recorded at all times. This along with a visible blinking red light indicating such. Where is the audio in the files provided to date? Where audio is provided by the police, why is it so poor and unintelligible?

Am I expected to believe that an old beat up cell phone recording inside of an evidence bag provides better audio than a permanent camera/microphone installation inside a government building which I was told was there for the sole purpose of limiting the legal liabilities of government employees?
The Port Moody Police Information and Technology Section (IT Section) needed to bring in a third-party to assist in working the computer files. If this is the case, surely there is a Work Order and/or an Invoice for such? Who was the Contractor? Who was the Third-Party? What work did they perform?

Why do the Police insist on Gmail, a corporation that deleted my Victim Service Emails to the police? Why did the police *delete* my Facebook Review of their "Services"? Why did the police block my accounts and delete my commentary publicly stated over Facebook?
Why did the police tell me that there are no services available for my person because I am MALE? Why did the RCMP delete and block Facebook Accounts of mine for bringing the same to their attention publicly? Am I here to simply be violated, abused and driven into my death in order to maintain a “Status Quo”?
These are things I ponder, and more. I am sure that you will appreciate that I have stripped out two pages of potentially unnecessary commentary for your ease of reading. Thank you for your assistance in these matters.

Thank you for your email. Please note that our case files are opened and assigned in order of receipt. The OIPC is an administrative tribunal and is bound by the rules of administrative fairness and justice. It would not be fair to other applicants to put another file ahead of theirs. Even if it were possible to expedite your files, review and complaint files could not be mediated or resolved immediately because mediation requires time to allow all parties an opportunity to be heard and this cannot be done in just a couple of weeks. There is also no guarantee that we would make a finding in your favour. If we found that the public body is authorized to withhold the information, we would uphold their decision to do so. When your files comes up in the queue, you will receive an assignment letter from an Investigator. You will be able to contact the investigator directly at that time.
