On March 9, 2023 at 0700 hours Cst CLEAVE was alerted by a concerned citizen that Daniel BERLADYN had recently been making very concerning comments on gab.com (gab) and Facebook.com (FB), possibly triggered by an upcoming 30th reunion for Port Moody Senior Secondary School grads. Cst CLEAVE went on FB and gab and located profiles under the name "Dan BERLADYN". On gab, 16 hours prior, Berladyn posted "I could not even work today, all I wanted to do is get a guin (sp) and kill all you pieces of garbage in government..." further down continued "I really need to get a gun and shoot at many people as I can". On FB, 4 days prior, "I hope you get RAPED, TORTURED and KILLED Desere Fanzega Kazulin" and further down continued "I am already dead. There is no recovery for me. I have taken so much damage from the corruption here that I am already dead. There is no recovery. My only decision is who to take out in response. Just killing myself is not intelligent." Both of these posts can be read in text pages "PS_EXH_FACEBOOK POST_BERLADYN, DAN" and PS_EXT_GAB POST_BERLADYN, DAN" and saved case files. BERLADYN was located at his home at 530 Foress Drive and arrested for uttering threats x2, chartered, warned and agreed to UTA conditions not to contact GLUMAC or KAZULIN, not to attend anywhere they live, work or reasonably might be, as well as, to present himself to a bail supervisor and not to possess any weapons. After agreeing to these conditions BERLADYN signed the UTA and was released. BERLADYN has since left a message for BC Probations stating that he is in severely degraded health and the only safe thing to do is to burn down the house and kill himself, then mentions not having money to buy gasoline. Cst CLEAVE phoned and advised BERLADYN's mother, Margaret BERLADYN about the voice message and comment about burning down the house. Margaret believes that BERLADYN loves the house too much to burn it down.

Cst CLEAVE is submitting an RTCC requesting a charge of Uttering Threats x2 as well as a Section 111 firearms prohibition.

On or about March 8, 2023 Dan BERLADYN did knowingly uttered a threat to kill Rick GLUMAC on "gab.com", under the user name Dan Berladyn @dberladyn, a blog that BERLADYN wrote "I couldn't even work today, all I wanted to do is get a guin(sp?) and kill all you pieces of garbage in government, you fucking CRIMINALS who ABUSED my person, my mother, my home, you fucking ridiculous RETARDS!!!", as well as, "Is so incompentent and so fucking corrupt that the reality dictates that I need to get a gun and shoot as many people as I can".

On or about March 5, 2023 Dan BERLADYN did knowingly utter a threat to harm Desere Fanzega KAZULIN on Facebook, under the user name "Dan Berladyn", BERLADYN wrote "I hope you get RAPED, TORTURED and KILLED Desere Fanzega Kazulin." and "I am already dead. There is no recovery for me. I have taken so much damage from the corruption here that I am already dead. There is no recovery. My only decision is who to take out in response. Just killing myself is not intelligent".

Application for a Prohibition Order Sec 111(1)CCC

Cst CLEAVE is requesting the Courts approve a Section 111(1) Prohibition Order against BERLADYN due to the multiple comments that BERLADYN has made on Facebook or in his blog, wishing to get a gun and kill people. Cst CLEAVE believes, on reasonable grounds, that it is not desirable in the interests of the safety of BERLADYN, or community at large, that BERLADYN should possess any firearm, cross-bow, prohibited weapon, restricted weapon, prohibited device, ammunition, prohibited ammunition or explosive substance, or all such things.

SYNOPSIS

On March 9, 2023 at 0700 hours Cst CLEAVE reviewed BERLADYN's user profile, "Dan Berladyn @dberladyn", on the social media platform "gab.com" and below were the following comments made by him on or about March 8, 2023:

GLUMAC NOTIFIED

On March 9, 2023 at 1557 hours Cst CLEAVE phoned Rick GLUMAC (GLUMAC), who is a public political figure and the MLA for Port Moody-Coquitlam. GLUMAC did not answer the call Cst CLEAVE left him a voice message.

On March 10, 2023 at 0953 Cst CLEAVE phoned GLUMAC. Cst CLEAVE explained the reason for the call was due to the "gab.com" post that BERLADYN made naming GLUMAC. Cst CLEAVE read GLUMAC the "gab.com" post. GLUMAC was not aware about the post, but was familiar with BERLADYN's name as he had been repeatedly posting things on GLUMAC's public Facebook page that GLUMAC's staff felt were offensive to people in the community. GLUMAC's staff had been hiding each offensive post that BERLADYN made, eventually it was decided that GLUMAC's staff would block BERLADYN from GLUMAC's Facebook. Cst CLEAVE advised GLUMAC that on March 9, 2023 BERLADYN had been arrested for uttering threats against GLUMAC as well as a second person, and released on no contact conditions. Cst CLEAVE asked GLUMAC if he would be interested in providing an audio recorded statement.

GLUMAC stated that he was concerned about his safety after hearing about the post but was worried that BERLADYN would be sent to jail. Cst CLEAVE re-iterated that BERLADYN was released with no contact conditions whereby not to have any kind of direct or indirect contact with GLUMAC. Cst CLEAVE added that if BERLADYN did breach his condition that it should be reported to the police immediately. GLUMAC received another call, put Cst CLEAVE on hold and the call was disconnected.

On March 10, 2023, after waiting to hear back from GLUMAC, Cst CLEAVE phoned GLUMAC back. GLUMAC asked if he could call me back before 1600 hours in order to provide a statement.

On March 10, 2023 at 1604 hours Cst CLEAVE phoned GLUMAC back. GLUMAC asked Cst CLEAVE to call him back at 1630 hours.

Cst CLEAVE reached out to the Port Moody Police Patrol members and asked one of them could assist in taking GLUMAC's statement as Cst CLEAVE was leaving work for the day. Cst Zabrina BRAITHEWAITE-KELSO offered to take GLUAMC's statement for Cst CLEAVE.

STATEMENT OF RICK GLUMAC

Start time 1638 hours

  • GLUMAC was not aware of the threat until Cst CLEAVE phoned him and told him that a concerned member of the public reported it to police;
  • His understanding was that after hearing the post read by Cst CLEAVE, that someone wanted to kill him;
  • GLUMAC does not know BERLADYN, but may have met him once;
  • BERLADYN is known to post things on GLUMAC's public page (GLUMAC is a local politician);
  • His understanding was that BERLADYN posted offensive comments that had been "hidden" by GLUMAC's staff, but then reposted multiple times until staff blocked BERLADYN from being able to post further comments;
  • GLUMAC would ahve been fine allowing BERLADYN to continue posting on GLUMAC's page if BERLADYN would rephrase things in a way that was not offensive to others;
  • When GLUMAC was told about the threats he was disappointed because he doesn't have any negative feelings toward BERLADYN;
  • Cst BRAITHWAITE-KELSO asked how the threat made GLUMAC feel; and
  • GLUMAC stated it is frightening, and that he has to take something like that seriously and that is concerned for his safety.

SOCIAL MEDIA REVIEW - FACEBOOK POST

On March 9, 2023 at 0700 hours Cst CLEAVE reviewed BERLADYN's user profile, "Dan Berladyn", on the social media platform "Facebook" and below were the following comments made by him on or about March 5, 2023:

Attached to the post is a video of a young (20's) white female in military clothing and helmet driving a vehicle. The video lasts 18 seconds an no words are spoken. The sound of explosions are heard in the audio.

KAZULIN NOTIFIED

On March 9, 2023 at approximately 0934 hours Cst CLEAVE phoned KAZULIN and explained she had been named in a concering Facebook post. Cst CLEAVE then read KAZULIN the post. Cst CLEAVE explained that on March 9, 2023, BERLADYN had been arrested for uttering threats against KAZULIN as well as another person. Cst CLEAVE explained that BERLADYN had been released on conditions not to contact KAZULIN directly or indirectly, or to go to any place she worked or could be reasonably be expected to be. Cst CLEAVE asked KAZULIN if she would like to provide a statement. KAZULIN agreed that she would provide a statement.

KAZULIN'S STATEMENT

Cst CLEAVE obtained an audio-recorded statement from KAZULIN, over the telephone. The following is Cst CLEAVE's summary of that statement.

Start time 0932 hours.

  • Known Dan since high school;
  • Haven't had much actual contact since the last high school reunion 10 years ago;
  • KAZULIN was one of the last people who had not blocked Dan online because he has posted a lot of crazy things over the years;
  • Lately Dan started posting things on KAZULIN's Facebook page about the Ukraine and she asked him to stop;
  • Dan continued posting so KAZULIN sent Dan a personal message stating that she was blocking him and that she was the last person that would talk to him and he has ruined that, which is why she was blocking Dan;
  • Since blocking Dan, KAZULIN has not heard anyhting from him until police called her;
  • The post worries KAZULIN a lot as no one has ever said anything like that;
  • There was another Facebook page for the upcoming 30 year high school reunion;
  • Because Dan was posting on the reunion page, the page was shut down;
  • Cst CLEAVE read the Facebook page comment to KAZULIN;
  • Cst CLEAVE then asked KAZULIN if the following excerpt from Dan's post was possibly the message that KAZULIN sent to Dan before she blocked him:

    "---I was one of the last people that have not blocked you.....If you want to share stuff, share it on your own page.I am now blocking you---"

  • KAZULIN believes this may be the message that she sent BERLADYN prior to her blocking him;
  • Cst CLEAVE asked KAZULIN "does this cause you to be concerned for your safety?"
    KAZULIN replied "yes, a little bit, yes";
  • Cst CLEAVE stated that "he is blocked on your Facebook so you did not get this message";
    and KAZULIN replied that she did not;

CST CLEAVE'S ASSESSMENT OF SOCIAL MEDIA POSTS BY DAN BERLADYN

Cst CLEAVE has been familiar with BERLADYN since she started working at the Port Moody Police Department as a dispatcher in 2007, and then becoming a sworn officer in 2015. Cst CLEAVE has been the Department of Mental Health Officer since the beginning of 2020 and has been more directly involved in files involving BERLADYN. BERLADYN has been known to use language around comments about his "person" being murdered by the police, wanting to commit suicide by walking into traffic in front of the police department so that police can clean up the mess they caused and shooting police if they come onto his property.

Cst CLEAVE has become increasing concerned with BERLADYN's recent post on Facebook and blog on Gab as there appears to be an escalation in his behaviour as to how he wants to cause harm to others - similar to what had occurred in 2020 where he made posts about getting a gun and killing people (2020-2808).

ASSISTANCE OF COQUITLAM RCMP

BERLADYN does not like the Port Moody Police Department, and is not favourable toward the women of the Port Moody Police. In the past Cst CLEAVE has asked Coquitlam RCMP Cpl Scott KLEIN, of the Mental Health Unit, to assist with arresting BERLADYN. BERLADYN has been more cooperative with Cpl KLEIN than he has been with Cst CLEAVE. The following is an excerpt from Cpl KLEIN's statement which can be read in full on Cpl KLIEN's "Police Statement" page.

At approximately 1530 hours, Constable CLEAVE called Corporal KLEIN to seek additional supports to now attend BERLADYN's residence in Port Moody. Both Corporal KLEIN and Constable SHAH were at the Coquitlam RCMP detachment, and both made their way to the Foress Drive area of Port Moody where a meet point was sent with Port Moody PD.

A plan was then formulated to have both Corporal KLEIN and Constable DIXON attend the residence to conduct a door knock, and attempt to speak with BERLADYN about his mental well being and arrest him for the utter threats charges. At approximately 1627 hrs both Corporal KLEIN and Constable DIXON walked up to the residence together, with other members strategically in place near the residence. Members walked to the open garage which then led to a door inside the garage that led into the house. It was believed that BERLADYN resided in the basement suite of the house. Constable DIXON knocked on the basement door, and shortly after a male voice could be heard from the inside. There was a silence for a while, and more knocks where done and it was announced that police were outside the residence. The male on the inside could be heard yelling and upset that police were there, he eventually opened the basement door at approximately 1630 hrs. Corporal KLEIN immediately recognized the male as Daniel BERLADYN, from previous interactions with him with Constable CLEAVE. BERLADYN was angry that police were there, and he was visibly shaking in the presence of the two police officers standing in his garage. BERLADYN continued to raise his voice with Constable DIXON, and spewed about the Port Moody Police and how they were all killers and he wanted nothing to do with them. Constable DIXON annouced that in fact they brought the "Mounties" to assist, and that was when BERLADYN focused on Corporal KLEIN who introduced himself and advised that he was an RCMP member. BERLADYN advised he did not want to talk with any Port Moody officer around, and advised he would come out and walk over the nearby park to talk with Corporal KLEIN.

Both BERLADYN and Corporal KLEIN walked together down the driveway, and turned left to walk over a bit to a grassy area where the nearby park started. Corporal KLEIN advised that the police were there to check on his well being due to the recent online threats he had made where he had threatened voilence and to shoot some people. BERLADYN continued to be visibly upset with police talking with him, he kept reverting back to old things that happened at this house with police, and his deep hatred of the Port Moody Police and it's officers. After speaking with BERLADYN for about 10 minutes it was determined that BERLADYN did not meet the criteria to be apprehended under s.28 of the Mental Health Act.

Corporal KLEIN and BERLADYN about the threats he made online and he didn't want to talk about that information, he just kept talking about past issues with the Port Moody Police adn it's officers. At approx 1640 hrs Corporal KLEIN advised BERLADYN that he was under arrest for the utter threats he made online, he was good abou that and was placed into handcuffs without incident by Constable DIXON. BERLADYN was searched incidental to arrest and he only had his cigarettes, lighter, wallet, phone and keys with him. BERLADYN continued to spew about the Port Moody police and actually could not get off track with that throught in his head.

Constable DIXON formally arrest, charter warned BERLADYN from her prepared card, BERLADYN did not properly reply to the questions asked of him instead he chose to focus on the fact he wanted to connect with his lawyer via the internet as that was the only way he communicates with his lawyer. BERLADYN continued to be rude and disrespectful toward Constable DIXON and eventually Constable CLEAVE who had walked to the driveway after BERLADYN was in custody. BERLADYN did not wish for any Port Moody officer to deal with the UTA adn asked that Corporal KLEIN take over doing that task. Corporal KLEIN then took BERLADYN to the side of the driveway where it was explained to him there were certain conditions to follow and abide by, court and finger print dates etc, and that he needed to acknowledge this and sign, in order not to be held in custody on this matter tonight. BERLADYN complained aobut the "report to bail supervisor" portion of the conditions but eventually he signed the document and a copy was left for him. BERLADYN was released from custody at approx 1700 hrs after he signed for the UTA.

Corporal KLEIN advised BERLADYN that he was not going to be taken to the hospital and that he did not meet the criteria to need to be taken there, he then said he was having chest pain and wanted to go to the hospital. An ambulance was called by DIXON, which arrived shortly after, and upon BERLADYN seeing the two EHS staff were both female, he refused service from the ambulance. BERLADYN continued his rude and disrespectful comments to the EHS staff who then drove away.

UTA

On March 9, 2023 at approximately 1700 Cpl Scott KLEIN, of the Coquitlam RCMP, assisted the Port Moody Police by issuing Daniel BERLADYN an undertaking, in the driveway of his house. Cpl KLEIN explained the undertaking to BERLADYN.

BERLADYN agreed to the following conditions, in order to be released.

  • You must report to "Bail Supervisor" at 2620 Mary Hill Road in the Province of British Columbia on March 10, 2023 at 4:00PM and afterwards as required.
  • You must not communicate, directly or indirectly with Rick GLUMAC or Desere KAZULIN.
  • You must not go to any place of employment, place you can reasonably expect GLUMAC or KAZULIN to be.
  • You must not possess a firearm, cross-bow, prohibited weapon, prohibited device, possession and also any authorization, license or registration certificate or other document enabling you to acquire or possess them.

After this was explained BERLADYN signed the UTA and was released.

At approximately 1630 hours,
Cst DIXON and Cpl KEIN attended the basement door of 560 Foress Dr. Cst DIXON knocked 4 times, after each knock, Cst DIXON identified herself as Port Moody Police. Cst DIXON could hear a male (btb BERLADYN) yell at her but she was unsure what was said. After the 4th door knock, BERLADYN answered the door and began to yell about random things including "you murdered me, you are are destroying my person". BERLADYN eventually agreed to speak with Cpl KLEIN outside of his residence.

Cst DIXON stood by while Cpl KLEIN spoke with BERLADYN who was continuing to yell about corruption in the police, in the government and with the medical system "Commu-med".

Cpl KLEIN arrested BERLADYN for Uttering Threats (online comments). Cst DIXON placed BERLADYN in handcuffs.

At 1644 hours,
Cst DIXON read BERLADYN his Charter of Rights from the issued Charter card.

STATEMENT of CST CHRISTIE DIXON / ARREST

At approximately 1420 hours, Cst DIXON attended the area of BERLADYN's residence (Basement - 560 Foress Dr, Port Moody). Cst DIXON held an outer perimeter until it was determined that Cst DIXON and Cpl KLEIN (Coquitlam RCMP) would conduct a door knock at BERLADYN's residence.

Cst DIXON and Cpl KLEIN attended the basement door of 560 Foress Dr. Cst DIXON knocked 4 times, after each knock, Cst DIXON identified herself as Port Moody Police. Cst DIXON could hear a male (btb BERLADYN) yell at her but she was unsure about what was said. After the 4th door knock, BERLADYN answered the door and began to yell about random things including "you murdered me, you are destroying my person". BERLADYN eventually agreed to speak with Cpl KLEIN outside of his residence.

Cst DIXON stood by while Cpl KLEIN spoke with BERLADYN who was contining to yell about corruption in the police, in the government and with the medical system "Commu-med".

At 1642 hours,
Cpl KLEIN arrested BERLADYN for Uttering Threats (online comments). Cst DIXON placed BERLADYN in handcuffs.

At 1644 hours,
Cst DIXON read BERLADYN his Charter of Rights form the issued Charter card.

Read: 10(a), do you understand?
Answer: I'd rather not.

At 1645 hours,
Read: 10(b), do you understand?
Answer: I don't know why this system is so corrupt.

Read: Do you want to call a lawyer?
Answer: The internet is my lawyer, let me go inside and speak with a lawyer online, on my computer.

At 1646 hours,
Read: Official Warning
Answer: I've been severely abused by police, you people are unbelievable, you are unbelievable.

BERLADYN then stated that he wanted to go see a doctor for some medical attention, Cst DIXON asked him what was wrong, BERLADYN stated he was "murdered from all the years of abuse by police" (while smoking a cigarette).

Cst DIXON stood by while Cpl KLEIN released BERLADYN on a UTA with conditions.

Cst DIXON requested EHS, who attended within approximately ten minutes. Cst DIXON noted that as the EHS members arrived, BERLADYN approached the passenger side of the ambulance and began to yell at the 2 female paramedics and called them "useless" and continued to swear at the paramedics. Cst DIXON asked BERLADYN if he was declining medical attention from the EHS crew, which he stated yes "you are all useless".

Cst DIXON departed the scene and returned to the office.

SYNOPSIS OF VOICE MESSAGE LEFT FOR BC PROBATION

On March 22, 2023 Cst CLEAVE opened an email from S/Sgt THOMPSON, that was sent to Cst CLEAVE on March 13, 2023, when Cst CLEAVE was away from the office. The email stated the following.

"Hi Sam, I was contacted by the Sheriffs today who advised that BERLADYN recently left a voice mail for the Probation office. That voice mail is attached to this email and probably should be included in your package to Crown. I've placed a copy of the voice mail in Case Files."

The following is a summary of the 3 min 33 second voice message:

  • BERLADYN is checking in for Port Moody file 23-1255(this file).
  • Declares himself as the Canadian Citizen who declared before a Provincial court Judge during a teleconference hearing that he has been murdered by the state in Port Moody cells.
  • He is in severely degraded health, the only safe thing to do is burn down the house and kill myself, BERLADYN (mentions gasoline) states that he does not have the health to permit the bail office, courts and law enforcement to abuse his mental and physical health any further.
  • He has been murdered by the state and does not exist
  • The only thing left to do is to cease biological function
  • He has requested charges of murder and gross negligence, sent to Peter NG
  • The only thing left to do is to cease biological functioning
  • I am already dead
  • I know someone who can execute you fucking people
  • Your entire office is full of criminals
  • You're disgusting people, have a nice weekend

On March 22, 2023 at approximately 1311 hours Cst CLEAVE phone and spoke with BERLADYN's mother, Margaret BERLADYN (Margaret), as BERLADYN lives in the basement of his mother's home. Cst CLEAVE advised Margaret that BERLADYN had left a voice message for BC Probation and that voice message stated that the only safe thing left to do is to burn down the house and kill himself.

Margaret had spoken with BERLADYN earlier on that day and he seemed fine. BERLADYN had spoken with the person that Margaret hired to water her plants and take care of the lawn, which was out of character for BERLADYN. Margaret stated that she does not believe BERLADYN would burn down the hosuse because he is extremely attached to the house.

HISTORY

BERLADYN has been a long time Port Moody resident who is well known to the Port Moody Police Department for files involving concerns for this mental health. The Port Moody Police Department have special flags on BERLADYN's file because he has threatened to shoot police and commit suicide by cop. The Port Moody Police Department have often received reports about BERLADYN posting about wanting to kill himself, and he has been apprehended under Section 28 of the Mental Health Act. It is extremely alarming when BERLADYN posts about getting a gun and killing people. Below are a few file examples of this.

2017-3040

Port Moody Police were notified that BERLADYN wrote the following on his blog https://dan.berladyn.online/wp/, expressing his desire to commit suicide in front of the Police Department so that the police can clean up their own mess.

"...What I wrote last year is true, I might likely end up in a position from all the extra damage you [referring to the Port Moody Police Department] caused to my life where I have no choice but to kill myself. I just decided over the last month, that if I ever do that, I am going to to do it right in front of your Department. In the very least, I will do it in Port Moody. You can clean up your own mess..."

2018-578

The Port Moody Police were notified by the Office of the Police Complaints Commissioner that BERLADYN sent them the following

"There is a very likely change that I will end up choosing to commit suicide as I have been in holding for months."

"Do you want me to just disappear?"

"I drop my belongings off there (his mother's house) in a plan to get into hospital before I end up killing myself"

"...which can only mean they want to drive me into suicide."

2020-2808

Port Moody Police were notified that BERLADYN used a blog platform "dan.berladyn.online" to express himself. BERLADYN's blog state the following:

"The reason I say people are stupid is because they are. The get played."

"Oh my God. Someone should have done something. Someone should have violated his Natural Rights."

"I almost wish I would start KILLING PEOPLE. I just do. I said to a friend the other day, I could probably KILL ten people before I am stopped. If the police are as pathetic as they have been in helping me with my needs, I can probably KILL 50 people before I am brought to a stop. This is without even using a gun - which even more idiots want to ban. I mean you people are so fucking stupid."

These words prompted the Port Moody police to apprehend BERLADYN under Section 28 of the Mental Health Act after a lengthy stand off, where the Emergency Response Team had to be called out.

BAIL COMMENTS / RECOMMENDATIONS

Cst CLEAVE respectfully requests that the following court ordered conditions be placed upon BERLADYN.

  • No contact directly or indirectly, including using social media, to refer to Rick GLUMAC;
  • No go to Rick GLUMAC's residence, place of work, or anywhere that Rick Glumac could reasonably expected to be;
  • No contact directly or indirectly, including using social media, to refer to Desere KAZULIN;
  • No go to Desere KAZULIN's residence, place of work, or anywhere that Desere KAZULIN could reasonably be expected to be;
  • Not to attend any of the activities for the 30th reunion for the Port Moody Secondary School graduates; and
  • Not to possess any accelerant that could be used to start a fire.
